NEW YORK DIVORCE AND DOMINICAN REPUBLIC “ONE-DAY DIVORCE”
New York will give full faith and credit to a foreign divorce in cases where both parties agree to the foreign divorce and participate in the process. In 1971, the Dominican Republic amended its laws regarding divorce so as to permit foreigners to obtain a divorce in ONE DAY without any residence requirement. Many Americans who are in need of a “one-day divorce” have utilized this exception to accomplish a fast divorce.
REQUIREMENTS TO OBTAIN A DIVORCE IN THE DOMINICAN REPUBLIC:
- BOTH PARTIES MUST AGREE TO THE DIVORCE AND EXECUTE ALL NECESSARY DOCUMENTS AGREEING TO THE DOMINICAN DIVORCE. The attorney’s at Keil & Siegel will prepare those documents for you in New York;
- ONE PARTY MUST BE PRESENT IN THE DOMINICAN REPUBLIC. The absent party must sign a power of attorney agreeing to have a representative appear on his/her behalf;
- Once all of the documents are prepared, the clients must take the documents to the Dominican Consulate where they are authenticated. The parties will need to provide their original marriage certificate, original birth certificates of children as well as an agreement detailing the parties property settlement, custody, etc. The consulate MUST authenticate all documents being submitted in a Dominican court.
